Cryptocurrency and Estate Planning Workshop - Thursday 26th November 2026

This session will focus on the practical application of the Property (Digital Assets etc) Act 2025, including will drafting considerations, estate administration challenges, and risk management for practitioners. This training is intended to equip will writers and estate planners with the knowledge and confidence required to advise clients competently on digital assets within the modern legal framework.

This session will include:  

• What cryptocurrency and digital assets actually are, in plain English
• How and where clients typically hold these assets
• Why exchanges, wallets, private keys, seed phrases and 2FA create unique estate planning risks
• Why “digital assets” can be too vague as a fact-find question
• The difference between ownership, access, authority and security
• What legal recognition of digital assets means in practice, and what it does not solve
• Why lost access, missing records and unclear instructions can create problems for executors and families
• What should be documented, and what should never be written into a will or client file
• How to raise digital assets confidently during fact-finding and review meetings
• Executor suitability, probate risks and practical estate administration issues
• How to use supporting documents such as inventories, letters of wishes and instruction packs
• High-level tax, gifting, trust and incapacity considerations, including when to signpost
• Practical case studies showing where client files can become difficult
• How to build this into your process without becoming a crypto expert
