Course Description:

The programme consists of 2 standalone courses run on the same day, so you can attend one or both as required.

Morning session -  Deputyship in the Court of Protection

 Add a new string to your bow! Often your client doesn't have the capacity to make a Lasting Power of Attorney so how can you help? By knowing the processes and procedures involved in making an application for Deputyship, you can assist your client in obtaining Deputyship for their incapacitated relative.

 

Afternoon session - Advising Clients with disabled beneficiaries

 This course looks at how to advise clients who may have disabled beneficiaries for whom they wish to make provision and looks at solutions to ring fence means tested benefits.

 

It is recommended that this course is suitable for delegates who have passed their IPW entrance examination and have covered the other basic courses (ie Lasting Powers of Attorney/Advising the Elderly) and/or have up to 1 year’s relevant knowledge or experience.

Session 1 – 9.15 am – 12.45 pm   Deputyship in the Court of Protection

  • Who can make the application?

  • What the Deputy’s responsibilities are

  • How the application is made?

  • What forms are used?

  • What happens after submission of forms?

  • What happens after the order has been made?

  • Support from the court

 

Session 2 – 1.15pm  - 4.45 pm -  Advising Clients with disabled beneficiaries

This course looks at how to advise clients who may have disabled beneficiaries for whom they wish to make provision and looks at solutions to ring fence means tested benefits. By the end of the session you will have a wider understanding of:

  • The legal definition of a disabled beneficiary
  • Definition of a Disabled Persons Trust
  • How to make adequate provision for a disabled beneficiary –what concerns might the client have
  • How to shelter assets from means testing
  • Why have a trust?- Advantages
  • Types of Trust available
  • Other options to a Disabled Persons Trust
  • The tax advantages and treatment of disabled persons trusts
  • Vulnerable Persons election
  • Deadline for making a Vulnerable Persons election
