Advising the Elderly

Course Description:

Aims:    A one-day course to confirm knowledge and introduce delegates to Advising the Elderly 

Prerequisites:  some experience in writing Wills is required

Led by Sue Ioannou this one day course will provide the specialist knowledge and understanding necessary to deal with elderly clients and to be able to deal with their concerns.

Outcomes:  By the end of the course, with the aid of their course notes delegates will be able to:

 

1.     understand and appreciate the market

 

2.     understand and appreciate the Issues affecting elderly clients

 

3.     be able to access capacity using Banks v Goodfellow

 

4.     take  instructions from elderly clients avoiding a future “Lark v Nugus letter”

 

5.     complete land registry forms for a mutual severance of joint tenancy and a unilateral severance of      joint tenancy

 

6.     understand care fee mitigation and be able to advise clients of various options

 

7.     draft Wills to include life interest or rights to residue

 

8.      be able to choose an appropriate testamonium and  attestation clauses

 

9.     be able to explain to clients how the trusts (in 7 above) in their Wills are taxed after their death.

 

10.   discuss pre-paid funeral plans

Institute Entrance Examination

VULNERABLE PERSONS

Course Description:

The programme consists of 2 standalone courses run on the same day, so you can attend one or both as required.

Morning session -  Deputyship in the Court of Protection

 Add a new string to your bow! Often your client doesn't have the capacity to make a Lasting Power of Attorney so how can you help? By knowing the processes and procedures involved in making an application for Deputyship, you can assist your client in obtaining Deputyship for their incapacitated relative.

 

Afternoon session - Advising Clients with disabled beneficiaries

 This course looks at how to advise clients who may have disabled beneficiaries for whom they wish to make provision and looks at solutions to ring fence means tested benefits.

 

It is recommended that this course is suitable for delegates who have passed their IPW entrance examination and have covered the other basic courses (ie Lasting Powers of Attorney/Advising the Elderly) and/or have up to 1 year’s relevant knowledge or experience.

Session 1 – 9.15 am – 12.45 pm   Deputyship in the Court of Protection

Session 2 – 1.15pm  - 4.45 pm -  Advising Clients with disabled beneficiaries

This course looks at how to advise clients who may have disabled beneficiaries for whom they wish to make provision and looks at solutions to ring fence means tested benefits. By the end of the session you will have a wider understanding of:

  • The legal definition of a disabled beneficiary
  • Definition of a Disabled Persons Trust
  • How to make adequate provision for a disabled beneficiary –what concerns might the client have
  • How to shelter assets from means testing

  • Other options to a Disabled Persons Trust
  • The tax advantages and treatment of disabled persons trusts
  • Vulnerable Persons election
  • Deadline for making a Vulnerable Persons election

A one day course for people who want to take Will instructions on behalf of an existing member of the Institute.

The course consolidates knowledge and training which is already expected to have been provided by the existing member and prepares candidates for the examination procedure.

Candidates are expected to have read and have a thorough understanding of the course book 'A Basic Guide to Taking Will Instructions'
